Terms of Use
These Terms are an agreement between you and Punctilious Permutations, LLC (“we”, “us”), a Utah company, about your use of Dibs — our pickup-sports app and website (the “Service”). By creating an account or using Dibs you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Dibs.
The short version
- Be at least 13, keep your account to yourself, and tell the truth on it.
- Zero tolerance: no harassment, hate, threats, sexual content or spam. We remove content and suspend or ban accounts that break the rules.
- Sports carry real risk. You play at your own risk and you're responsible for your own safety and health.
- Plans renew monthly until you cancel. Wallet money stays in Dibs and can't be cashed out right now.
- You can delete your account in the app any time.

1. Who can use Dibs
You must be at least 13 years old to use Dibs. If you're under 18 (or the age of majority where you live), you may use Dibs only with the permission of a parent or guardian who agrees to these Terms for you. [JP: confirm 13+. Lawyer: decide whether paid entries, the wallet, subscriptions and prize competitions should require 18+ — the app doesn't check age for those today.] You can't use Dibs if we've previously banned you, or if you're barred from using it under applicable law.
Some games and leagues set their own age or gender requirements; the person or organization running them decides those.
2. Your account
- Use your real name and keep your information accurate. Don't impersonate anyone.
- One person, one account. Don't share your account or sign-in, and keep your password safe. You're responsible for what happens on your account.
- League organizer accounts belong to the person using them, acting on behalf of their organization; you confirm you're authorized to act for that organization.
- Tell us right away at hello@punctiliouspermutations.com if you think someone else is using your account.
3. Community rules — zero tolerance
Dibs is for playing ball, not for hurting people. We have zero tolerance for objectionable content and abusive users. You may not post, send or do any of the following — in posts, comments, chat, photos, profiles, team or group names, ratings, or in person at a Dibs game:
- Harassment, bullying, intimidation or stalking.
- Hate speech or slurs, or attacks on anyone because of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or similar characteristics.
- Threats or encouragement of violence or self-harm.
- Sexual or sexually suggestive content, nudity, or any content that sexualizes minors.
- Spam, scams, unauthorized advertising or solicitation.
- Impersonation, or sharing someone else's private information (like their address or phone number) without permission.
- Illegal content or activity, including illegal gambling, or content that infringes someone else's rights.
- Cheating or gaming the system: fake accounts, fake check-ins, collusion, rating manipulation, or abusing reports or appeals.
- Interfering with Dibs: hacking, scraping, overloading our systems, or getting around a block, suspension or ban.
Talking trash about the game is part of pickup. Crossing into any of the above is not.
4. Reporting, blocking and enforcement
- Report anything that breaks these rules using “Report” on the post, comment, chat message, profile or league photo. Reports are private.
- Block any player from their profile or after reporting them. Blocked players can't see your posts or messages or contact you through Dibs, and they aren't told.
- Dibs automatically filters certain objectionable language.
- We review reports and aim to act on them within 24 hours. We may remove content, warn you, suspend your account, or permanently ban you — and we may also contact law enforcement where someone's safety is at risk. We decide what's appropriate, and we may act without warning for serious violations.
- If you think we got it wrong, email us and we'll take another look.
Post-game sportsmanship reviews are a separate fair-play feature (see section 10).
5. Your content
You own what you post on Dibs. By posting it, you give us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt (for example, resize a photo) and distribute it for the purpose of operating, improving and promoting Dibs. This license ends when you delete the content or your account, except for content others have already relied on as described in our Privacy Policy (such as anonymous game records), and except where we must keep it for legal reasons.
You're responsible for what you post. Only post content you have the right to share — including photos of other people, who should be OK with it. We don't pre-screen everything, but we can remove any content at any time.
League organizers are responsible for the schedules, results, statistics, photos, videos and announcements they publish, and for having the right to publish photos of their participants.
If you send us ideas or feedback, we can use them without owing you anything.
6. Games, hosting and fair play
- Dibs helps people find and organize games. We don't organize, run, supervise or referee pickup games, and we don't own or control the courts, fields or venues. Hosts and players arrange games among themselves.
- Hosts: describe your game honestly, follow the venue's rules, and cancel in the app if the game is off. Canceling a game refunds in-app entry fees to players.
- Players: show up when you commit. Check-ins, no-shows and late cancellations affect your Reliability Score and Prize Board points as the app describes.
- Location-verified check-in needs your device's location. Don't fake it.
- We don't run background checks on users. Use good judgment when meeting people.
7. Physical activity and assumption of risk
Sports and physical activity involve inherent risks, including injury, illness, disability and in rare cases death, and risks from other players, weather, and the condition of venues and equipment. By joining, hosting or attending any game, contest or league found through Dibs, you voluntarily accept those risks. You're responsible for deciding whether you're fit to play, for your own equipment and safety, and for any insurance you need. Talk to a doctor before starting a new activity if you have any concerns.
To the fullest extent the law allows, you release Punctilious Permutations, LLC from claims arising from injuries or losses that happen at games, contests or leagues you find or join through Dibs. [Lawyer: review this release for enforceability in Utah and whether a separate signed waiver is wise for official Dibs contests; leagues usually carry their own waivers.]
8. Plans and subscriptions
- Dibs is free to use. Optional paid plans — Basic, Premium and Premium+ — add features like Prize Board competition, AI game suggestions, Contest Credits and league stats. Current prices and what each plan includes are shown in the app before you buy.
- Purchases are made on the Dibs website, not through the App Store. Plans are billed monthly, starting the day you subscribe, and renew automatically every month until you cancel.
- Upgrades take effect right away; you pay the prorated difference for the rest of the current billing period. Downgrades and cancellations take effect at the end of the current billing period, and you keep your plan until then.
- If a renewal payment fails, your account moves to the Free plan right away. You can subscribe again at any time.
- Monthly allowances (AI game creations, Contest Credits) reset each billing period and don't roll over.
- Except where required by law or stated in these Terms, payments for plans are non-refundable, including for partial months. Deleting your account ends your plan immediately without a refund.
- We may change prices or plan features. We'll tell you before a price change affects your next renewal, and you can cancel before it does.
[JP/lawyer: today plans are paid from the wallet. When card billing launches, check the auto-renewal disclosures and online-cancellation requirements in the states where Dibs is offered.]
9. The Dibs wallet, fees and refunds
- The Dibs wallet holds a balance you can use inside Dibs for plans, contest and tournament entry fees, and league fees. Prizes and refunds are paid into it.
- Wallet funds can only be used in Dibs. They can't currently be withdrawn, cashed out or transferred to another user, they don't earn interest, and they aren't a bank account. [JP/lawyer: decide the cash-out policy before real money and cash prizes go live — paying “cash prizes” into a balance that can't be withdrawn is a problem, and holding user funds may raise money-transmission questions.]
- Entry fees. Paid tournaments and official contests charge the listed entry fee; Dibs keeps a platform fee from entry fees as shown in the app. If you withdraw before a game or contest starts, or it's canceled, your in-app entry fee (or Contest Credit, if its billing period hasn't ended) is returned. After it starts, entry fees aren't refunded.
- Venmo games. Some hosts collect money through Venmo. Those payments are between you and the host, outside Dibs; we don't process them, guarantee them, or handle their refunds.
- Deleting your account forfeits any wallet balance, including refunds credited during deletion. The app warns you before you confirm.
- We may correct errors in your balance, and reverse credits that came from fraud or mistakes.
10. Prize Boards, contests and prizes
[Lawyer: this whole section needs legal review before cash prizes go live. Paid entry or paid membership combined with prizes can fall under state gambling, lottery, sweepstakes and contest laws, which vary by state; Apple's App Store rules (guideline 5.3) also require official rules for contests and a statement that Apple isn't a sponsor. Dibs contests are intended to be skill- and activity-based, not chance-based — confirm that holds, and whether some states must be excluded. Decide tax reporting (e.g., 1099s for prizes of $600+).]
Prize Boards (monthly and annual leaderboards)
- Anyone can view the Prize Boards. Only members on a paid plan earn points and are eligible for Prize Board prizes, and only points earned while on a paid plan count.
- Points come from verified activity (checked-in games, hosting, contests, referrals and other rules shown in the app); penalties apply for no-shows, late bails, late check-ins and confirmed sportsmanship incidents. The point rules are shown in the app under “How do I get on this board?” and may change; changes apply going forward.
- Players compete in local groups. Prize pools are funded from a percentage of plan revenue actually collected, and the top finishers in each group share the pool as shown in the app. Prizes are paid into the Dibs wallet.
- Disqualification: two confirmed sportsmanship incidents in a month disqualify a player from that month's prizes; disqualification in two or more months of a year disqualifies a player from the annual prizes. A sportsmanship report only counts once another player from the same game confirms it, and you can appeal from your profile.
- We may also disqualify anyone who cheats, breaks these Terms, or manipulates points, and withhold or reclaim prizes won that way.
Official contests and Monthly Contests
- Each official contest shows its own rules, scoring, entry cost (a Contest Credit or a fee), eligibility and prizes in the app. Those rules are part of these Terms.
- Results are recorded by Dibs officials. Our decisions on results, ties and eligibility are final, except for clear errors we correct.
- Prize amounts, eligibility (for example, paid members only) and payment timing are as stated for each contest. Prizes are paid into the Dibs wallet. You're responsible for any taxes on prizes.
- Contests are void where prohibited. Apple is not a sponsor of, and is not involved in, any Dibs contest or prize.
11. Leagues
- Leagues on Dibs are run by independent organizers — cities, recreation departments, gyms, clubs and others — not by us. The organizer sets the rules, schedule, fees, eligibility, refunds and waivers, and is responsible for running the league and its venues.
- League fees you pay through Dibs go to the organizer. Withdrawing before a league starts refunds your fee; after it starts, refunds are up to the organizer.
- Organizers must follow these Terms, give accurate league information, handle participants' information only for running their league, and handle the fees they receive responsibly.
12. Third-party services
Dibs works with services from other companies — such as Google and Apple sign-in, Google Maps, OpenStreetMap, Venmo, calendar apps, and an AI provider for game suggestions. Your use of those services is subject to their terms, and we're not responsible for them. AI game suggestions are generated automatically: use your own judgment about whether a suggested game is safe and suitable for your group.
13. Ending your account
- You can delete your account at any time in the app (Settings → Delete account). What happens to your information is explained in the Privacy Policy.
- We may suspend or terminate your account, or limit what you can do, if you break these Terms, if required by law, or to protect other users or Dibs. When an account is banned for breaking the rules, any wallet balance may be forfeited [lawyer: confirm], and unearned or improperly earned prizes may be withheld.
- We may change, pause or discontinue any part of Dibs. If we shut Dibs down entirely, we'll give reasonable notice [JP: decide what happens to wallet balances in that case].
- Sections that by their nature should survive (like content licenses already granted, disclaimers, limitation of liability, indemnity and governing law) survive termination.
14. Disclaimers
DIBS IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We don't promise that Dibs will be uninterrupted or error-free, that games will happen as listed, or that information from users, hosts or league organizers (including ratings, Reliability Scores, results and venue details) is accurate. We aren't responsible for the conduct of any user, host or organizer, online or in person.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, PUNCTILIOUS PERMUTATIONS, LLC AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM GAMES, CONTESTS, LEAGUES OR MEETINGS WITH OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO DIBS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) $100. Some places don't allow some of these limits, so they may not all apply to you.
16. Indemnity
If you break these Terms or the law, or your content or conduct harms someone, you agree to defend and hold harmless Punctilious Permutations, LLC from the resulting claims, losses and costs (including reasonable attorneys' fees), to the extent the law allows.
17. Governing law and disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Before filing a claim, please email us so we can try to resolve it informally. Any lawsuit must be brought in the state or federal courts located in Salt Lake County, Utah, and you and we consent to those courts' jurisdiction. Nothing here limits rights you have under consumer protection laws that can't be waived. [Lawyer: decide whether to add an arbitration agreement and class-action waiver, or a small-claims carve-out.]
18. Apple App Store terms
If you got Dibs from Apple's App Store: these Terms are between you and us, not Apple, and Apple isn't responsible for Dibs or its content. Apple has no obligation to provide maintenance or support for Dibs. If Dibs fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); otherwise Apple has no warranty obligation. Apple isn't responsible for any claims relating to Dibs, including product liability, legal or regulatory compliance, consumer protection, privacy, or intellectual property claims — we are, as described in these Terms. You confirm you aren't in a country subject to U.S. government embargo or on a U.S. prohibited-party list. You must also follow any applicable third-party terms (such as your wireless carrier's). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
19. Changes
We may update these Terms. We'll change the date at the top, and if the changes are significant we'll tell you in the app before they take effect. If you keep using Dibs after changes take effect, you accept the updated Terms. If you don't agree, delete your account.
